CONCERNING
AMENDMENT TO THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 40/MPP/KEP/1/2003
ON IMPORTER IDENTIFICATION NUMBER (API)

THE MINISTER OF TRADE OF THE REPUBLIC OF INDONESIA,

Considering:

a. the Ministry of Trade has been separated from the Ministry of Industry on the basis of Presidential Decree No. 187/M/2004 on the Establishment of the United Indonesia Cabinet;
b. that the new organizational structure of the Ministry of Trade has been established on the basis of Regulation of the Minister of Trade No. 01/M-DAG/PER/3/2005 on the Organization and Working Arrangement of the Ministry of Trade;
c. that the Ministry of Trade has had new logo on the basis of Decree of the Minister of Trade No. 32/M-DAG/KEP/2/2006 on the logo of the Ministry of Trade;
d. that based on the matters as intended in a above, b and c, it is necessary to amend Decree of the Minister of Industry and Trade No. 40/MPP/KEP/I/2003 on Importer Identity Number (API);
e. that based on the considerations as intended in paragraphs a above, b, c and d, it is necessary to stipulate a regulation of the Minister of Trade;

In view of:

1. Trade Ordinance of 1934 (Statute Book of 1938 No. 86) as has already been amended and supplemented ;
2. Law No. 3/1982 on Corporate Registry (Statute Book of 1982 No. 7, Supplement to Statute Book No. 3214;
3. Law No. 7/1994 on Ratification of the Agreement Establishing the World Trade Organization (Statute Book of 1994 No. 57, Supplement to Statute Book No. 3564;
4. Law No. 10/1995 on Customs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612) as has already been amended by law No. 17/2006 (Statute Book of 2006 No. 93, Supplement to Statute Book No. 4661);
5. Law No. 32/2004 on Regional Administration (Statue Book of 2004 No. 125, Supplement to Statute Book No. 4437);
6. Government Regulation No. 13/1995 on Industrial Business license (Statute Book of 1995 No. 25, Supplement to Statute Book No. 3596);
7. Government Regulation No. 25/2000 on Authority of the Government and Authority of Provinces as Autonomous Regions (Statute Book of 2000 No. 54, Supplement to Statute Book No. 3952);
8. Presidential Decree No. 260/1967 on Affirmation of Tasks and Responsibility of the Minister of Trade in the Foreign Trade Sector;
9. Presidential Decree No. 187/M/2004 on Establishment of the United Indonesia Cabinet as has already been amended by Presidential Decree No. 171/M/2005;
10. Presidential Regulation No. 9/2005 on the Status, Tasks, Function, Organizational Structures and Working Arrangements of State Ministries, as has already been amended and the latest by Presidential Regulation of The Republic of Indonesia No. 90/2006;
11. Presidential Regulation No. 10/2005 on First-Echelon Organizational Units and Tasks of State Ministries as has already been amended and the latest by Presidential Regulation No. 66/2006;
12. Decree of the Minister of Industry and Trade No. 229/MPP/KEP/7/1997 on Import General Provisions;
13. Decree of the Minister of Industry and Trade No. 230/MPP/KEP/7/1997 on Goods Subjected to Import Control as has already been amended several times and the latest by Decree or the Minister of Industry and Trade No. 406/MPP/Kep/7/2004;
14. Decree of the Minister of Industry and Trade No. 12/MPP/KEP/1/1998 on the Implementation of Corporate Registry (WDP);
15. Joint Decree of the Minister of Finance and Minister of Industry and Trade No. 527/KMK.04/2002 and No. 819/MPP/KEP/12/2002 on Importer Administrative Order;
16. Regulation of the Minister of Trade No. 01/M/DAG/PER/3/2005 on Organization and Working Arrangement of the Ministry of Trade as has already been amended by Regulation of the Minister of Trade No. 30/M-DAG/PER/12/2005;
17. Regulation of the Minister of Trade No. 09/M/DAG/PER/3/2006 on Standard Provisions on the Issuance of Trading Business license;

HAS DECIDED:

To Stipulate:

THE REGULATION OF THE MINISTER OF TRADE ON THE AMENDMENT TO DECREE OF THE MINISTER OF INDUSTRY AND TRADE No. 40/MPP/KEP/1/2003 ON IMPORTER IDENTITY NUMBER (API)

Article I

Several provisions in Decree of the Minister of Industry and Trade No. 40/MPP/Kep/I/2003 on Importer Identity Number shall be amended as follows:

1. The provisions in Article 1 point 7 is amended so as to read as follows:

"7. The Minister is the Minister of Trade."

2. Article 20 paragraph (2) is amended so as to read as follows:

"(2) Model of API as contained in specimen in Attachments III and IV to this regulation is 29 cm in length, 19 in width and is printed by the Ministry of Trade on paper having logo of the Ministry of Trade."

3. Article 20 paragraph (5) is amended so as to read as follows;

"(5) In the case of changes in territory altering Code Number of province, the new code number is stipulated by the Director General."

4. Attachments III, IV, IX and XI are amended so as to as enclosed in this regulation.

Article II

API issued before the regulation is stipulated shall remain valid until expiring and abide by the provisions in this regulation.

The regulation shall start apply two months as from the date of stipulation.

For public cognizance, the regulation shall be published in State Gazette of the Republic of Indonesia.
